This is a summary proceeding to remove a tenant from month to month, who held over the term for which the premises were hired. It is conceded by both sides that this proceeding comes within the purview of section 228 of the Real Property Law. The only remaining issue before this court is whether the thirty-day notice served on the tenant was a proper notice.
The notice served on the tenant on October 29,1937, is set forth as follows:
