This case — and, indeed, this precise question — is now before the Court for the second time. Last Term, petitioner sought review of the decision of the Texas Court of Criminal Appeals affirming his sentence of death, asserting that evidence was received during the penalty phase of his trial in contravention of his Fifth and Sixth Amendment rights. After issuing our decision in Satterwhite v. Texas, 486 U. S. 249 (1988), we granted the petition for a writ of certiorari, vacated the Texas court’s judgment, and remanded for further consideration in light of Satterwhite. 487 U. S. 1230 (1988).…
