This is an appeal from a judgment of the United States District Court for the Western District of North Carolina, in favor of appellee, in a suit brought by appellant to recover damages for the death of appellant’s intestate.
M. B. Owens, as administrator of Wm. Owens, deceased, filed a complaint against the. Southern Railway Company in the superior court of Polk county, N. C., to recover $50,000 damages ,for the negligent killing of William Owens on the night of June 5, 1924.
