Plaintiff’s decedent was struck and killed by defendant’s automobile truck near the southeast corner of Ridge Avenue and Spring Garden Street in the City of Philadelphia. The accident occurred in daytime. There were no witnesses to the actual collision, although a traffic policeman stationed on the opposite corner saw both decedent and the truck a moment before and after the collision occurred. Defendant offered no evidence, but moved for a nonsuit at the close of plaintiff’s case, which motion was refused and the case submitted to the jury; a verdict was rendered…
