Judgment unanimously reversed, on the law and facts, and matter remitted to Supreme Court, Erie County, for further proceedings in accordance with the following memorandum: Defendant, a college student, was charged with murder for stabbing to death his good friend and fellow student in the victim’s dormitory room on the afternoon of March 5,1978. At his nonjury trial, defendant raised the defense of insanity (Penal Law, § 30.05).
