OPINION AND ORDER

BROWN, Judge.

This matter comes before the Court on Plaintiffs’ Motion for Partial Summary Judgment (#40) as to certain counterclaims and affirmative defenses raised by Defendants.

For the reasons that follow, the Court GRANTS Plaintiffs’ Motion for Partial Summary Judgment as to Defendants’ affirmative defenses of duress, mistake, un-conscionability, constructive fraud, and fraud and DENIES Plaintiffs’ Motion as to Defendants’ affirmative defenses of unfair trade practices and equitable mortgage.
