The board of rapid transit commissioners having adopted a route and general plan, and having failed to obtain the consent of the property owners along the line of the proposed railways, made application to the General Term for the appointment of commissioners as- provided for in the Rapid Transit Act (Laws of 1891, chap. 4, and the various acts amendatory thereof), and on the 15th of *292November, 1895, the General Term appointed three commissioners to determine and report, after due hearing, whether the railway determined upon by the said board and mentioned in its petition…
