The Jefferson County Board of Education and William Diemer, suing as a taxpayer and on behalf of the other taxpayers of the Jefferson County School District, instituted this declaratory judgment proceeding against Luther E. Goheen, Superintendent of the Kentucky Children’s Home at Lyndon, Kentucky, to secure an adjudication of the rights of the parties relative to the furnishing of educational facilities for children committed to the Home.
