OPINION

This is an appeal on questions of law from the Court of Common Pleas of Darke County, Ohio, wherein a judgment in favor of the plaintiff was rendered on the verdict, of the jury. The substance of the errors complained of consist of the failure of the Court to instruct the jury to return a verdict, at various stages of the trial, and in the failure of the Court to sustain the motion for a new trial and render judgment for the defendant, notwithstanding' the verdict, and that the verdict of the jury is against the manifest weight of the evidence.
