The action was brought in equity for the rescission of a contract for the purchase of real property in the city of New York and for the recovery of a down payment made by the plaintiff to the defendant of $5,000 upon the execution of a contract for the purchase of said real property, and the further sum of $299 claimed to have been expended by plaintiff in the examination of title of said real property.
