FLY, Associate Justice.

It appears from the transcript which accompanies the motion to affirm on certificate in this case that R. O. Smith had sued the city of San Antonio, and on the 8th day of April, 1901, recovered judgment against appellant in the sum of $2512.50. On May 25, 1901, appellant gave notice of appeal to this court. The court adjourned for the term on June 1, 1901, and on September 5th the motion to affirm the judgment on certificate was filed. Section 240 of the charter of the city of San Antonio provides that it shall not be required to give bond in any action or suit, and…
