The Gulf, Colorado & Santa Fe Railway Company having laid its track across the corner of a. lot in the city of Galveston belonging to the Galveston Wharf Company and erected certain buildings thereon, the latter brought suit against the former to recover for the use and occupation of the property, alleging a contract to pay $100 per month rent.
