C. L. Gaines, the appellee, was complainant in the court below and was the owner and holder of a mortgage on lands in Olay County, Florida, given by T. C. Gilbert and Alice J. Gilbert, his wife, to secure the sum of $12,000.00, secured by mortgage 'dated June 16, 1926, and recorded in the public records of said County on June 18, 1926.

The mortgagors defaulted in the payments provided for by the mortgage, and the complainant filed his bill for foreclosure on October 19, 1927. The defendants named in the bill were the mortgagors, and several other defendants. James…
