Doris Garand (Garand) brings this action against her landlord, Worcester Housing Authority (WHA), for negligence (Count One), breach of contract (Count Two), and breach of the implied warranty of habitability (Count Three). In February 2004, Garand slipped and fell on ice outside her apartment building, sustaining fractures to her hip, arm and wrist.
