Appeal from Municipal Court, Borough of Manhattan, Seventh District. Action by the American Manufacturing Company against Joseph Weintraub and another. Judgment for plaintiff, and defendants appeal.

The history, of this case is somewhat lengthy. Upon the return day the defendants demurred to the complaint. The demurrer was overruled, and an interlocutory judgment entered from which the defendants appealed. Subsequently, and on November 13, 1908, a final judgment was entered against the defendants. They appealed to this court from both the interlocutory and final judgments. On March 5, 1909, the interlocutory judgment was affirmed, and the appeal from the final judgment was dismissed.
