This was a criminal' prosecution for murder in the first degree. The defendants, Joseph W. McNutt and Arthur Winner, were duly charged by information of the county attorney with killing and murdering one W. W. Seiver, otherwise known as “Texas,” otherwise known as “Tex.” A separate trial was granted to the defendants, and Arthur Winner was tried, convicted, and sentenced, and he now appeals 'to this court.
