OPINION

This matter is before this court on an appeal from a judgment of the Court of Common Pleas based upon the verdict of the jury, finding the defendant guilty of the offense of selling and keeping intoxicating liquor in Darke County, Ohio in violation of the law.
On August 3, 1937, an affidavit of the *307prosecuting attorney was filed in which it is alleged that Eva Faeser did sell beer at retail, to-wit, one bottle thereof, not then and there being the holder of a permit authorizing such sale in violation of §8064-54 GC.
