Plaintiff, Saverio Senape (“plaintiff” or “Senape”), brings this ease pursuant to 42 U.S.C. § 1983, seeking injunctive relief and damages against defendants Joann A. Constantino, Deputy Commissioner of the Division of Medical Assistance for the New York State Department of Social Services; Cesar A.
