The statement of the nature and result of this suit, made by appellant and concurred in by appellee, is hereby adopted. The appellee Joe B. Vaughn, a minor, by his next friend, Willis Vaughn, filed this suit against Clara Vaughn, individually and as independent executrix of the last will and testament of her deceased husband, Ben F. Vaughn, on the 14lh of October, 1925, in the district court of Wilbarger county, alleging that Ben F.
