Owner unhappiness with a series of repairs to a John Deere 744J Loader (Waste Hauler) 1 inspired this litigation. Appellant, Consolidated Waste Industries, Inc. (“Consolidated Waste”) purchased the new Waste Hauler from Appellee, Standard Equipment Company (“Standard Equipment”), in June 2005. Twenty months later, the machine experienced hydraulic and operational issues. Standard Equipment was able to “repair” it, after two tries.
