M. A. Bailey, plaintiff in error, hereinafter called defendant, was convicted in the district court of Carter county, for the crime of manslaughter in the first degree, and sentenced to serve a term of four years’ imprisonment in the state penitentiary.

The defendant killed his brother-in-law, William Hunt, on the 2d day of May, 1926, on a public road southwest of the city of Wilson, on the highway between the city of Wilson and the town of Orr. It appears from the evidence of the state that Hunt was traveling north, and in the car with him were his wife and Bailey’s wife, who was Hunt’s…
