OPINION AND ORDER

NORGLE, District Judge.

Before the court is defendants’ motion to dismiss plaintiffs amended complaint for failure to state a claim. For the following reasons, the motion is granted.

DISCUSSION

Plaintiff Keith Diaz (“Diaz”) is an inmate currently incarcerated at the Stateville Correctional Center (“Stateville”) in Joliet Illinois. Prior to his confinement at Stateville, Diaz was imprisoned for approximately nine months at the Joliet Correctional Center (the “JCC”), Joliet, Illinois.
