Benson Maurice Moore (defendant) was convicted of statutory rape in violation of N.C. Gen. Stat. § 14-27.7A(a) and was sentenced to 300-369 months in prison on 11 June 2003. Defendant appeals.
The State’s evidence at trial tended to show that on 27 June 2001, defendant came to S.R.’s home to have her braid his hair. Defendant asked S.R. how old she was and S.R. replied that she had just turned fifteen. Defendant did not believe that S.R. was only fifteen.
