On August 31, 1982, plaintiff brought this action in state court against his employer, defendant James River-Otis, Inc. [Company], for breach of contract, and against his union, defendant Local No. 247, International Brotherhood of Firemen & Oilers, AFL-CIO [Local 247], for breach of its duty of fair representation. The action was removed to this court on October 7, 1982.
