THOMAS, District Judge.

On August 11, 1921, the defendant was convicted in the city court of Bridgeport, Conn., under an information charging in the first count that on August 5, 1921, he sold and exchanged, and offered or exposed for sale and exchange, spirituous and intoxicating liquors, and that said sale was not in accordance with a permit issued by authority of the United States, and in the second count that on said date he owned and kept such liquors with intent to sell or exchange them without a permit issued by authority of the United States.
