This was a claim filed by the appellant before the commissioners, and there disallowed. He then appealed to the circuit court, where there was a like decision. He then appealed to this court, where he has assigned as error the action of the circuit court.

The facts of the case are few. After the last call of the President of the United States for three hundred thousand troops, and on the 24th day of October, 1864, the commissioners made and entered on their minute book an order which, *223■with its caption, as found in the record now before us, reads as follows:

“Special Session, October-24th, 1864.
