The plaintiffs, Christopher S. Slade and Crossed Streams, Inc. (collectively “Slade”), com*80menced this action to assert claims for breach of contract, misrepresentation, promissory estoppel, impossibility, unjust enrichment, quantum meruit, mutual mistake, and violation of G.L.c. 93A, arising out of a 1988 agreement permitting Slade to remove sand and gravel from the property of the defendants, David L.
