HENDERSON, Judge.
Appellant was convicted of theft from the person, and his punishment assessed at two years confinement in the penitentiary, and prosecutes this appeal.
During' the trial the State put the witness John E. Martel on the stand. It seems that after examining the witness some time, he stated that he did not swear before the grand jury that he told this fellow (defendant) to take care of any money.
