Inasmuch as the questions presented by this appeal arise upon a demurrer based upon the ground that the complaint does not state facts sufficient to constitute a cause of action, it will be necessary to make a condensed statement of the allegations of the complaint, which are substantially as follows: that on or about the 17th of August, 1853, the plaintiffs made an agreement for an exchange of lands with Woodward Allen and his wife, the defendant, Harriet Allen, whereby the plaintiff was to convey to them a certain tract of land…
