STATEMENT OF THE CASE

Chicagoland Christian Village, Inc. appeals a summary judgment entered in favor of the Indiana Family and Social Services Administration and Division of Disability, Aging and Rehabilitation. We reverse and remand.

Indiana has a Room and Board Assistance Program (RBA) pursuant to the provisions of Indiana Code 12-10-6-1 et seq. Indigent individuals who are elderly, blind or disabled and are incapable of residing in their own homes receive a very small personal spending stipend and have reimbursement payments made on their behalf for residential care…
