CALABRIA, Judge.
*331 Defendant Marco Contractors, Inc. ("Marco") appeals from an order denying its motion to compel arbitration. For the reasons that follow, we affirm.
Background
This case arises from a construction contract for the renovation of a Wal-Mart, Inc. ("Wal-Mart") retail store. Marco, a construction management company based in Pennsylvania, regularly performs construction work for Wal-Mart. Plaintiff TM Construction, Inc.
