This is a petition for federal habeas corpus by a state convict in custody at the Missouri State Penitentiary. The petitioner is in custody under a judgment and sentence of the Circuit Court of Vernon County, State of Missouri, in which he was convicted of forcible rape in violation of § 559.260 RSMo (1949), V.A.M.S.
