This is an issue of law arising on the defendants’ demurrer to the complaint on the ground that it appears on the face thereof that'the same does not state facts sufficient to constitute a cause of action. ' The plaintiff is .a banking corporation, organized and existing under the acts of congress authorizing and' regulating- national banks. It is doing ’ business in the city of New York and its capital stock is $.1,000,000, divided into 10,000 *33shares held by more than 100 persons, some of whom were residents of other states.
