Appeal from Polk Circuit Cowrt. Action to recover tbe possession of personal property. Plaintiff claimed to be tbe owner, and as sucb entitled to the possession. The defendant denied that plaintiff was the owner or entitled to the possession, and also claimed that he was rightfully in possession, and that he was entitled thereto •as a partner of the plaintiff.

There was a trial by jury, and, under the instructions of the court, there was a verdict for the defendant, and judgment being rendered thereon, plaintiff appeals.

The plaintiff and the defendant entered into the following contract:
“This contract, made and entered into as of the 8th day of October, 1874, by and between Isaac Kuhn, of Des Moines, Iowa, of the one part, and M. Newman of the other part, witnesseth: That is to say, the said Isaac Kuhn is to furnish merchandise, chiefly clothing, sufficient to open a salesroom, and keep the same properly stocked for business, in a room now leased, heretofore occupied by J.
