In October 2005, the Kenton County Fiscal Court, on behalf of its Airport Board, condemned real property owned by Cordelia Bastón in Boone County. The condemnation was a small piece in the Airport Board’s plan to construct a new north/south runway for the Cincinnati/Northern Kentucky International Airport. Following a jury trial and in accord with the jury’s verdict, the Boone Circuit Court awarded Bastón compensation damages of $670,000.00. On appeal, a divided panel of the Court of Appeals reversed that award as excessive and remanded for a new trial.…
