OPINION
MURRAY M. SCHWARTZ, District Judge:
This opinion addresses the plaintiffs’ 1 motion for an order approving the Wilmington Board of Education’s establishment of a $40,000 escrow account to permit payment of legal fees and expenses for the continued representation of the plaintiffs’ interest in this litigation. 2 A summary of the procedural and factual background is necessary to place the matter presently before the Court in its proper perspective and to understand the nature of the controversy surrounding the establishment of this escrow fund.
