OPINION AND ORDER OF PUBLIC REPRIMAND

Leo Marcum and John R. Triplett were charged by the Inquiry Tribunal with violating DR 9.101(B), which provides that a lawyer shall not accept private employment in a matter in which he had substantial responsibilities while a public employee.

The facts in this case are not in dispute. Mr. Marcum and Mr. Triplett were law partners in a firm initially titled “McCoy and Marcum,” but later changed to “McCoy, Marcum & Triplett.” In January 1988, Mr. Marcum was sworn in as Commonwealth’s Attorney for the counties of Martin, Lawrence, and Johnson.
