In answer to a suit brought against him by the state of Texas to recover delinquent taxes regularly levied, assessed, and shown, to be delinquent, appellee Davisson pleaded that the taxes sued for had been fully paid. The payment alleged was predicated upon the following facts: Appel-lee purchased the property against which- the taxes had been assessed from, the commissioner of banking, who had charge of the property as legal receiver of an insolvent state bank, the owner.
