OPINION OF THE COURT

CAPPY, Justice.

This case is before the Court as an automatic direct appeal from the judgment of sentence of death. 1 Following a trial before a jury, appellant was found guilty of murder in the first degree, robbery, possessing an instrument of a crime and conspiracy. 2 At the penalty phase hearing the jury was presented with evidence of three aggravating circumstances: the defendant committed the killing while in the perpetration of a felony; 3 the defendant has a significant history of felony convictions involving the use or threat of violence to the person; 4 and, the…
