Cross appeals from an order of the Supreme Court (Smyk, J.), entered January 9, 1991 in Broome County, which, inter alia, partially granted plaintiff’s motion for summary judgment.

Defendant Peter G. Cafferty applied for a mortgage from plaintiff to finance the purchase of a large tract of land in the Town of Windsor, Broome County, and to develop the infrastructure on a portion for a residential community.
