OPINION
LEDERBERG, Justice.
This case came before the Supreme Court on the appeal of the defendant/counter-claimant, Eastern General Contractors, Inc. (Eastern). Eastern has appealed from an order of the Superior Court that granted the motion for directed verdict of the plaintiff, Rhode Island Hospital Trust National Bank (Hospital Trust), and entered judgment for the plaintiff on Hospital Trust’s petition for declaratory judgment and on Eastern’s counterclaims.
