The defendant was indicted upon a charge of aggravated assault upon a police officer, by means of a loaded rifle, at Laconia on August 24, 1969. RSA 585:22(supp.). Trial by jury resulted in a verdict of guilty of simple assault. RSA 585:21(supp.).
