COCHRAN, Special Associate Justice.

Appellee brought this suit, alleging that appellants on December 1, 1900, executed and delivered to him a deed, intending to convey a tract of twelve acres of land in Milam County, but that a mistake was made in the description of the land. He- further alleged that after the execution of the deed he rented the land to appellants for the succeeding year by paroi contract, and that they had repudiated the contract, refusing to pay the rent or 'surrender the possession. The prayer of the petition was for the correction of the deed, for possession and for rents.
