This ease presents questions concerning the scope of federal question jurisdiction under the Federal Declaratory Judgment Act and the applicability of federal usury limitations to variable rate loans. Union National Bank of Laredo and Will M. Nelson, seek review of the decision of the district court dismissing Union’s declaratory judgment complaint for lack of subject matter jurisdiction and granting Union summary judgment on Nelson’s usury counterclaim.
