Plaintiff Louis M. Pihakis ("Louis") appeals from a summary judgment granted in favor of defendant James M. Pihakis ("James"). We affirm.

The affidavits and depositions offered in support of, and those in opposition to, the motion for summary judgment reveal the following. In 1968, Louis obtained a piece of property located in Huntsville, Alabama, at a foreclosure sale. He assumed a first mortgage on the property and paid approximately $7,500 to acquire title.
