In an action to recover on a note and to foreclose a mortgage, plaintiff appeals from an order of the Supreme Court, Westchester County (Marbach, J.), dated June 4,1981, which denied its motion for summary judgment on the ground that in their opposition papers defendants Waccabuc Investors, Inc., and Louis Boniello had raised an issue of fact precluding summary judgment by asserting that a subsequent oral modification of the note provided that it need not be paid until the Royal American Corporation paid its later mortgage to D.
