This action challenges the right of the tax commission to exercise certain powers granted by the legislature under subdivisions Seventh and Eighth of § 1, chapter 127, Laws of 1935, p. 378, Rem. 1935 Sup., § 11091 [P. C. § 6874-5a]. The challenge, in effect, goes to the constitutionality of certain portions of those subdivisions. Before discussing the ques tioned grants of power, it will be well to ascertain tbe historical background of the act itself.
