PROCEDURAL BACKGROUND
This matter comes before the court on a motion in limine brought by Datek-Instacard Corporation (“Datek”) in the course of an estimation proceeding. The motion seeks a ruling whether the doctrine established by the United States Supreme Court in D’Oench Duhme & Co. v. FDIC, 315 U.S. 447, 62 S.Ct. 676, 86 L.Ed. 956 (1942) (“D’Oench, Duhme”) applies to the claims at issue in this proceeding.
