MORRISON, Presiding Judge.
Relator, an inmate of the penitentiary, seeks his release by writ of habeas corpus alleging that he has served the sentences against him. From the record we learn the following:
On September 20, 1954, relator was convicted in the 99th District Court of Lubbock County in Cause No. 5320, for the felony offense of defrauding with a worthless check and was sentenced to three years, but the execution of such sentence was suspended and relator was placed on probation. Subsequently, on September 19, 1955, relator was convicted in causes numbered 5559 and 5601 in said court…
