Reversing.

John P-aymond was struck by a street car of the Louisville Railway Company on October 16, 1906. On November 24, 1906, he made a compromise with it by which he accepted $20 in full settlement of all claims which he had against it as a result of the accident. He died on May 19, 1907, and on May 1, 1908, this action was brought against the railway company by his personal representative to recover damages for 'the loss of his life; it being alleged that his death was the result of the injury he received, and that this was by reason of the negligence…
